'인생 최고의 안전운전 및 정속운전'모드로 집에 온 후, 이게 도대체 뭔가 하고 인터넷을 검색해 보셨겠죠. 

그러다 이 누추한 곳까지 흘러들어오셨을 거라 믿습니다.

걱정마세요. 저도 저 딱지 받고도 무탈하게 미국 생활 계속 하고 있으니까요.

일단 혹시나... 하는 기대감 따위는 중요치 않으니, 현실적인 이야기부터 하고자 합니다.

※ 이 글은 버지니아 주 기준으로 작성되었습니다.

※ ticket에 보면 위반한 법률 숫자가 나와 있습니다. 속도 위반 정도와 상관없이, 

   티켓 발부 경관이 적어준 이 법률 숫자가 적용됩니다.

※ Reckless driving이면 변호사 고용하지 않는 한 Court 가셔야 합니다.

※ Speed limit 의 1.1배까지는 안전한 편입니다. (ex. 60마일 구간서 66마일까지, 65마일 구간서 71마일까지)

Intro

나도 모르게 규정 속도를 초과하여 과속을 하던 중, 갑자기 백미러와 사이드미러에서 경찰차 불빛이 나타난다면?

갓길에 차 세워야지요. 

- 불빛 보여서 갓길에 차 세울 때, 안전한 곳에다 정차하셔야 합니다. 

  갓길 정차가 아닌 도로 일부를 점유하는 정차 등은 이것도 도로규정 위반으로 간주하여 따로 티켓을 줍니다.

- 경찰차의 종류는 참 다양합니다. 흰색, 검은색, 회색 등 다양한 색상 및 

  심지어는 경광등이 차량 내부 인테리어로 있어서 겉보기에는 일반 승용차와 완전히 동일한 경찰차까지...

- 만약 당신이 약간 과속을 하고 있는데, 시야에 경찰차 비스무리한 것이 눈에 들어왔다면? 이미 늦은 겁니다.

당황, 황당, 짜증, 분노, 두려움 등 복합적인 감정에 휩싸여 있다는 거, 잘 압니다.

하지만, 일단 누구 하나 다친 곳 없이 티켓만 받았다는 사실에 대해 감사하게 생각하는게 정신 건강에 좋습니다.

1. 버지니아주(VA) 벌점 및 벌금 제도

● 면허정지 기준

 - 최근 1년간 18점 or 최근 2년간 24점 이상 벌점 누적시 90일간 면허정지

● 벌점 관련

 - 기 취득 벌점은 취득일로부터 2년 후 자동 삭제

 - 보통 벌점은 1~6점에서 형성 (내가 정확히 얼마의 벌점을 받았는지는 추후 인터넷으로 확인해야 함)

 - 과속의 경우, 10마일 이내 2점, 10~19마일 3점, 20마일 이상 6점 등 다양하나, 

   실제 부과되는 벌점은 케이스별로 상이함.

● 벌금 관련

 - 일반 과속의 경우, 초과 과속 1mile당 U$ 6이 부과된다. (스쿨존은 1 mile당 U$ 7)

 - 티켓 받으면 뒷면 혹은 추가로 주는 종이에 벌금 관련 내용이 잘 나와있다..

ex) 60마일 제한구간에서 80마일(General speeding)과속 적발의 경우 / 이게 제 경우입니다.

2. Reckless Driving

속도위반(Speeding) 등 교통티켓을 받을 때, 가장 중요한 것이 'Reckless'여부입니다. (이하 RD)

이게 한국말로 난폭운전인데 일반 교통법규 위반시보다 처벌 수위가 높습니다.

RD에는 속도 위반, 역주행, 위협운전 등 여러 종류가 있는데, 

가장 높은 비율을 차지하는 것이 아무래도 과속이 아닐까 싶습니다.

RD 기준은 주마다 다른데, 버지니아 주의 경우는 아래와 같습니다.

a. 기준 speed limit + 20miles over

b. 80 miles over

둘 중 하나라도 충족할 때, RD입니다.

예1) Speed limit 55 / 76 miles : RD

예2) Speed limit 55 / 75 miles : 애매함. (경찰관이 티켓에 적어주는 법령 번호를 인터넷 검색해봐야 암)

예3) Speed limit 70 / 85 miles : RD

예4) Speed limit 60 / 80 miles : 애매함. (경찰관이 티켓에 적어주는 법령 번호를 인터넷 검색해봐야 암)

※ 따라서, 과속을 하더라도 70마일 넘어가는 과속은 지양하는 것이 좋습니다. 

   왜냐하면, 내 차 계기판에 70~75 사이로 찍히더라도, 경찰관 스피드건에는 80넘게 찍히기도 하거든요.

버지니아주는 RD를 일반 교통법규 위반이 아니라, 경범죄(Misdemeanor)수준으로 여기는 주입니다. (좀 엄격한 편)

일반 교통 법규 위반시, prepayment를 통해서 Court를 가지 않고도 티켓 처리가 가능하지만,

RD의 경우는 본인 혹은 선임변호사가 Court에 출두해야 합니다.

참고로 과속으로 인한 RD는 벌점 6점이 부과됩니다.

3. 전체 프로세스_티켓 수령부터 결제 완료까지

A. 법규 위반 현장에서 경찰관에게 티켓 수령

- 해당 티켓에 어디 코트로 언제까지 출두하라는 소환장 내용이 기재되어 있음.

- 보통 위반일로부터 2달 후의 날짜가 적힘. 

- 이유는 지역별로 Court가 1주일에 1번씩 (ex. Nelsons county는 매주 수요일) 열리는데, 

  당신이 티켓 받기 이전에 이미 티켓을 받아서 출두 대기를 하고 있는 사람들이 누적적으로 쌓여있기 때문에, 

  대략 2달 정도 후의 날짜가 찍힙니다.

- 해당 위반 사실은 위반한 주(state)의 traffic ticket 웹사이트에 1주~1달 이내에 전산 등록됩니다.

- pre-payment 가능한 경우, 위 사이트에 접속해서 결제 후 case 종결이 가능합니다.

B. 티켓과 관련된 bill이 먼허증에 명시된 내 거주지로 발송 (안 오는 경우도 있음)

- 보통 법규 위반일로부터 2주 내에 수령 가능

- 안 오는 경우도 있음

- 법정출두일 1일 전까지(보통 티켓에 납부기한일 및 시간이 명시되어 있음) 

   온라인 or 우편메일 check 납부시, court 면제(Waive)

- pre-payment하지 않고 Court 가겠다! 의 경우, 그냥 가만히 있다가 해당 일에 court 출두

C. 법정 출두

- Court에 출두해서 자기 차례까지 대기 (당일 법정에는 수많은 과속위반자 및 기타 법규위반자로 가득함) 

- 자기 차례가 되면 각종 어필을 통해 벌점 및 벌금 감면 negotiation을 진행

- 초범에 정말 운 좋은 경우에 전체 waive까지 가능하다는 전설적인 이야기도 있으나, 직접 경험한 바는 없음.

- 다른 경우로 인한 전체 waive도 있음 (하단 시나리오 참조)

※ 법정 출두시 발생 가능한 시나리오

- 1 : 원티켓 그대로 벌금 및 벌점을 받는 경우 

      (이렇게 되면 차라리 prepay가 낫겠죠?)

- 2 : 벌점 지우는 대신, 그만큼의 벌금을 추가로 납부(surcharge)하는 경우  

      (벌점이 오르면 보험료 상승이 되기 때문에, 이렇게 하는 경우도 많음)

- 3 : 벌점 지우는 대신, 추가 벌금 및 traffic school(온라인/오프라인) 수료 후, 수료증을 court에 제출하는 경우

      (traffic school은 정말 여러 사이트 및 종류가 존재하기에, 

       구글 혹은 기타 웹사이트 검색 후 진행하시길 권장합니다.)

- 4 : 벌점 지우는 대신, traffic school만 수료하는 경우

- 5 : 벌금 및 벌점 지우는 대신, traffic school만 수료하는 경우

- 6 : 아예 봐주는 경우 (초범이라던지, 당신을 적발했던 경찰관이 

      출두일 당일 court에 미출두해서 case자체가 dismiss되는 경우)

- 참고로 법정에 출두하게 되면, 6의 일부를 제외한 어떠한 경우라도 court fee는 납부하게 되어 있습니다. 

- prepayment라고 해서 court fee를 안 내는 것이 아닙니다.

- 보안문자 입력 후, 나오는 화면 좌측 사이드바에 알아서 해당되는 항목에서 search

- Name search : 당신 이름으로 검색

- Case number search : 케이스 번호로 검색

- Hearing date search : 티켓에 기재된 법정 출두일 기준으로 검색

- Service/Process search : case 진행 상황에 따른 검색

※ 보통 court를 먼저 선택한 후, hearing date search로 검색하는 것이 제일 정확합니다. 

- 이름이나 케이스 번호는 경찰관이 오기해서 입력하는 경우도 있습니다.

- 모든 정보를 몰라도, 빨간색 * 표시된 정보만 입력하고 search해도 검색이 됩니다.

※ 해당 court는 당신의 거주지가 아니라, 티켓에 명시되어 있는 court를 의미합니다. 헤메지 마시기 바랍니다.

4. 면허 정지 관련

- 아래는 면허 정지 관련 내용입니다.

- 여러분이 구글링을 하다보면 아래와 같은 내용들을 접하게 되실 겁니다.

Each time you commit a traffic offense, DMV adds additional demerit points to your record. This can add up to big trouble for some drivers.

Drivers Under 18

If you are convicted of a demerit-point traffic violation committed when you were under age 18, you will be required to satisfactorily complete a driver improvement clinic. If you do not satisfactorily complete the clinic within 90 days, DMV will suspend your permit or license until the clinic is completed. After your second demerit point conviction if the violation was committed when you were under age 18, DMV will suspend your permit or license for 90 days. After a third demerit point conviction if the violation was committed when you were under age 18, DMV will revoke your permit or license for one year or until you reach age 18, whichever is longer. You will be required to attend a driver improvement clinic for safety belt and child restraint violations as well as demerit-point convictions. You will receive five safe driving points if you volunteer for a clinic. Safe driving points will not be awarded if clinic attendance was required by DMV or a court. A computer-based driver improvement clinic will not satisfy a driver improvement clinic requirement. You must satisfactorily complete a clinic that provides classroom instruction.

Drivers Age 18 and Over

If you are age 18 or 19, you will be required to complete a driver improvement clinic after your first demerit point conviction if the violation was committed while you were under age 20 (including safety belt and child restraint violations). If you are 18 and older and you accumulate eight demerit points in 12 months (or 12 points in 24 months), you will receive an advisory letter that cautions you about the consequences of violating the law. If you accumulate 12 demerit points in 12 months (or 18 points in 24 months), you will be required to complete a driver improvement clinic. You must enroll in and satisfactorily complete the driver improvement clinic within 90 days. If you accumulate 18 demerit points in 12 months (or 24 points in 24 months), your driving privilege will be suspended for 90 days. Additionally, you must complete a driver improvement clinic before your privilege will be restored. Once your privilege is restored, you will be placed on a six-month probation. 

If you are under age 20, a computer-based driver improvement clinic will not satisfy a driver improvement clinic requirement. You must satisfactorily complete a clinic that provides classroom instruction. A driver improvement clinic will put you back on the road to safe driving When you satisfactorily complete a driver improvement clinic, you'll learn defensive driving techniques that can help you avoid and prevent crashes. These eight-hour classroom sessions cost no more than $75 and are offered at sites around the state and as a computer-based course on the Internet. Contact the court to be sure it will accept a computer-based course. Also, if you are under age 20, you must enroll in a clinic that provides classroom instruction. If DMV requires you to attend a clinic, you must complete the entire eight-hour course. If you fail to satisfactorily complete the clinic within 90 days, your driving privilege will be suspended until you meet this requirement. If you are attending college outside of Virginia or you are a member of the military or a military dependent and stationed outside of Virginia, you may be eligible for an extension of the 90-day requirement. The extension will be granted only if you are in an area where no approved clinics are offered. The extension will last until a break in your schedule. If you hold a commercial driver's license (CDL) or committed an offense while operating a commercial motor vehicle, and you are required to attend a driver improvement clinic, you must satisfactorily complete a commercial driver improvement clinic designed specifically for commercial drivers. 

If you are 18 or over, you may be awarded five safe driving points after you successfully complete a driver improvement clinic. If a court requires you to complete a clinic, the court determines whether you will be awarded safe driving points. Insurance companies may offer premium discounts to policyholders under 55 years of age who complete a DMV-approved driver improvement clinic. Check with your agent to see if your insurance company offers this benefit. If you take a driver improvement clinic to reduce your insurance premium, you will not be eligible to receive safe driving points. If a court assigns you to complete a clinic, you will not be eligible to receive the insurance premium reduction.

 

Drivers on Probation

If you are convicted of a traffic offense that was committed while you were on probation, your driving privilege will be suspended. The suspension period depends on the number of demerit points assigned for the violation.

• 3 point violation = 45 day suspension

• 4 point violation = 60 day suspension

• 6 point violation = 90 day suspension

Once you complete the suspension period, you will be placed on probation for another six months.

If you are convicted of a traffic offense that occurred while you were on probation for the first time, you may request DMV to grant you restricted driving privileges. If you violate a second or subsequent probation, DMV will grant you restricted privileges only if the probationary period during which the violation occurred was immediately preceded by a control period (an 18-month time period during which your driving record is monitored).

Restricted driving privileges granted by DMV allow you to drive only

• to and from your place of employment,

• during employment hours only if driving is a required part of your job,

• to and from school if you are a student,

• for medical treatment, including necessary transportation of an elderly parent,

• to transport your minor child to and from school, day care or for medical treatment; or

• to and from a court-ordered visitation with your child.

Restricted driving privileges are not available to operate a commercial motor vehicle.

Drivers Under Control Period

If you receive demerit points for a violation during the 18-month control period, you will be placed on six months probation. Once you successfully complete the control period, you will exit the Driver Improvement Program.

- 처리 방식은 만 18세 미만과 그 외로 나뉜다. (이하는 만 18세 이상 기준)

  (직장, 학교, 의료적 치료, 학교, 법정 출두) / 상업용 운전은 이 경우에도 금지

- 티켓을 자세히 보면 뭔가 숫자가 적혀있을 겁니다.

- C.46.2-870이면 일반 과속 위반입니다.
